General Terms and Conditions of Hotel MORGENROTH
Valid from March 1st, 2025
1. Operator and Scope
The operator of the hotel is Rodvi GmbH, Gustav-Töpfer-Straße 4, 07422 Bad Blankenburg, Germany, registered in the commercial register of the Jena Local Court under commercial register number HRB 522817,
VAT ID No.: DE352758721, Tax number: 010/206/07536
(hereinafter referred to as “Hotel”). These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all accommodation contracts, reservations, submission of offers and all related services – whether for a fee or free of charge. The contracting parties undertake to comply fully with these conditions. The GTC apply equally to corporate events, conferences, private celebrations, wellness stays and group bookings.
2. Conclusion of Contract (§§ 145 ff. BGB [German Civil Code])
2.1. The contract is concluded by the hotel accepting the reservation – in writing, orally or electronically.
2.2. The contracting parties are the hotel and the guest. If the booking is made by a third party on behalf of the guest, both are jointly and severally liable.
2.3. Reservations can be made directly with the hotel or via third-party providers (e.g. Booking.com, Expedia, etc.).
2.4. Bookings via external providers are also subject to their terms and conditions. The hotel accepts no liability for third-party conditions.
2.5. The hotel reserves the right to reject reservations in the event of data irregularities, non-payment of deposits, excessive multiple bookings under the same name or suspicion of fraudulent intent. If the safety of guests or staff is endangered, the hotel can also cancel bookings without compensation.
3. Prices, Services and Payments (§§ 535, 612, 288 BGB)
3.1. The hotel undertakes to provide the booked accommodation capacities and agreed services in accordance with these GTC.
3.2. The guest is obliged to pay the agreed prices in full within the deadlines stipulated in the contract or by these GTC.
3.3. The prices are inclusive of the applicable statutory value added tax. Changes in the law may require price adjustments.
3.4. Special services such as catering, parking, wellness treatments, event rooms or technical equipment may be charged additionally according to the current price list.
3.5. The hotel may require deposits or a payment guarantee (e.g. credit card). If a cancellation occurs, a refund of the deposit is only possible by special agreement.
3.6. Payments are due immediately upon receipt of the invoice. In the event of default, statutory default interest will be charged in accordance with § 288 BGB. The hotel has a statutory right of retention to the guest’s belongings brought in in accordance with § 704 BGB.
4. Withdrawal, Cancellation, No-Show (§ 537 BGB)
4.1. A right of withdrawal exists only within the scope of the contract, the statutory provisions or with the written consent of the hotel.
4.2. The cancellation conditions of the respective portal apply to bookings made via portals.
4.3. In the event of a no-show, the hotel is entitled to charge the total amount or at least the price of the first night.
4.4. Complaints must be sent within three days of knowledge to the following e-mail address: Info@hotel-morgenroth.de.
4.5. Special cancellation conditions apply to group bookings, events and wellness packages, which will be sent to the guest or organizer upon booking.
5. Arrival and Departure (§ 535 BGB)
5.1. The guest has no claim to a specific room unless this has been expressly agreed.
5.2. Arrival is possible from 2:00 p.m.
5.3. Departure must take place by 10:00 a.m. at the latest.
5.4. A later check-out may be charged according to the price list.
5.5. Early departure does not give rise to any claim for reimbursement of services not used.
6. Liability of the Hotel (§§ 701 ff. BGB)
6.1. The hotel is only liable for damages in the event of intent or gross negligence.
6.2. The hotel is liable for items brought in in accordance with § 701 BGB. The use of the hotel safe is recommended.
6.3. In the event of force majeure (e.g. natural disasters, pandemics, power/water failures), the hotel is not liable.
6.4. The hotel is not liable for health damage as a result of non-compliance with operating rules, unauthorized use of wellness or event areas or similar.
6.5. For events and group bookings, the organizer is liable for damage caused by participants.
7. Limitation of Liability and Conduct of Guests (§ 280 BGB)
7.1. The guest is liable for damage to hotel property caused by him.
7.2. Guests are obliged to comply with the house rules and follow the instructions of the staff. In the event of gross violations, the stay may be terminated without compensation.
7.3. Smoking is only permitted in designated areas.
7.4. In the event of serious disturbances of the peace at night, the hotel reserves the right to impose a contractual penalty and exclude the guest from the stay.
8. Events, Wellness Area and Groups (§§ 305 ff. BGB)
8.1. Individual rental conditions and technical requirements apply to the use of event rooms (e.g. weddings, seminars, conferences), which are regulated separately by contract.
8.2. The use of the wellness area is at your own risk. Children under the age of 14 may only enter this area when accompanied by an adult.
8.3. Group bookings of 6 people or more are considered a special agreement and are subject to special cancellation, payment and liability conditions. These will be communicated to the group representative upon booking.
8.4. Organizers are responsible for the behavior of their participants and are jointly and severally liable for damage to the hotel’s property.
8.5. Own technical equipment and decorations may only be brought in with the express permission of the hotel.
9. Final Provisions (§§ 305 ff. BGB)
9.1. Amendments and additions to the contract or these GTC must be made in writing.
9.2. The place of performance and payment is the registered office of the hotel.
9.3. German law applies exclusively.
9.4. Should individual provisions of these GTC be invalid, the remaining provisions shall remain unaffected.
9.5. The place of jurisdiction for disputes is the competent court at the registered office of the hotel.
